Private Treaty

The standard negotiated sale — offers, counter-offers, cooling-off rights.

What is Private Treaty?

Private treaty is the most common property sales method — the seller sets an asking price (or price range), and buyers negotiate offers with the agent. Includes cooling-off period (in most states) and allows conditional offers (subject to finance, inspection, etc.).

Why it matters for you

Unlike auctions, private treaty gives you time, flexibility, and cooling-off rights. You can make a conditional offer subject to finance and building inspection. The trade-off: less urgency can lead to longer negotiation periods, and price discovery is less transparent.

Pre-approval strengthens your offer

Free. No pressure. No credit check.
